Introduction

These Terms and Conditions constitute an agreement between you and BBC Worldwide Limited ("BBCW") a company incorporated in England and Wales with company number 01420028, whose registered office is at Media Centre, 201 Wood Lane, London W12 7TQ through its BBC International Television division.

By entering the site you accept these terms and conditions and are legally bound by them. The terms and conditions are subject to change at any time, and it is your responsibility to check these terms and conditions regularly in case there are any changes. Continuing to use the site after a change has been made constitutes your acceptance of the changes.

If these Terms and Conditions are not accepted in full, you do not have permission to access the contents of this website and therefore the use of this site must be terminated immediately.

Copyright

All rights, including copyright and database right, in this website and its contents (including all text, images, software, illustrations, artwork, high resolution photography, video clips, audio clips and any after-sales material), are owned by or licensed to BBCW, or otherwise used by the BBCW as permitted by applicable law.

Limitation on Use

Television Broadcast

This is a business-to-business site that is primarily intended to provide information about BBCW's products and service to potential customers in the broadcast industry. The site is not for individuals. The site is intended as a catalogue of material which is available to be licensed by BBCW’s customers.

Any other use requires the prior written permission of BBCW.

It also provides access to certain material that has already been licensed under an agreement with its broadcast customers and with the BBCW (“After Sales Material”).

For the avoidance of doubt, access to all After Sales Material is provided subject to BBCW Customers entering into a licence agreement with BBCW for the relevant rights acquired. In addition, the After Sales Material has only been cleared for publicity purposes in connection with the broadcast of the specific Programme (broadcast meaning standard, cable and satellite television only). You agree to abide by any usage embargo dates and only to utilise the publicity materials following the publicity launch of the respective commissioning broadcaster.

Save for (a) any samples as specifically allowed for review purposes including pre-sale marketing material and programme information eg brochures, information sheets, press kits and (b) any After Sales Material, material may not be downloaded, copied, reproduced, republished, uploaded, linked to, stored in any medium (including in any other website), distributed in any way, posted, shown or played in public, broadcast, transmitted or re-transmitted in any way.

You agree not to edit, modify, adapt, reverse engineer, change in any way, alter or create any derivative work from any of the content contained in this site or streamed to you. You agree to use this site only for lawful purposes, and in a manner which does not infringe the rights of, or restrict or inhibit the use and enjoyment of this site by any third party.

Non Television Broadcast

Any other media use of the After Sales Material by non broadcast customers such as DVD and Digital Media (eg VOD, Download to Own, Download to Rent, etc) will require the prior written permission of BBCW and may also require additional clearance from the featured talent or copyright holder and be subject to an additional cost

You shall indemnify BBCW, its affiliates and licensors against any losses, expenses, costs or damages incurred by any or all of them as a result of your breach of these terms and conditions or your unauthorised use of any content from this website.

The BBC Worldwide Online Catalogue is for information only. Nothing on this site amounts to an offer by BBCW to supply any goods or services. The fact that a particular product or service is featured in the catalogue does not necessarily mean that it is available.

Trade Marks etc

The names, images and logos identifying the BBC, BBCW or third parties and their products and services are proprietary marks of BBC, BBCW and/or third parties. Nothing contained herein shall be construed as conferring by implication, estoppel or otherwise any licence or right under any trade mark or patent of the BBC, BBCW, or any other third party.

This site and the content, information, names, images, pictures, logos and icons regarding or relating to the BBC and/or BBCW, its products and services (or to third party products and services), is provided "AS IS" and on an "AS AVAILABLE" basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.

Subject to damages for death or personal injury or any other loss which is not permitted to be excluded by law, in no event will the BBC and/or BBCW be liable for any damages including, without limitation, indirect or consequential damages, or any damages whatsoever (whether such losses were foreseen, foreseeable, known or otherwise) arising from use or loss of use, data, loss of revenue or anticipated profits, loss of business, loss of opportunity, loss of goodwill or injury or reputation or profits, whether in action of contract, negligence or other tortious action, arising out of or in connection with the use of the site or download of any material.

BBCW does not warrant that the functions contained in the material contained in this site will be uninterrupted or error free, that defects will be corrected, or that this site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy or reliability of the materials.

Enforceability

If any of these Terms and Conditions should be determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these Terms and Conditions are intended to be effective, then to the extent and within the jurisdiction which that Term or Condition is illegal, invalid or unenforceable, it shall be severed and deleted from this clause and the remaining Terms and Conditions shall survive, remain in full force and effect and continue to be binding and enforceable.

If there is any conflict between these Terms and Conditions and/or specific terms appearing elsewhere on this site relating to specific material then the latter shall prevail.

Governing Law

These Terms and Conditions and any contract arising between BBCW and you as a result of your use of this website shall be governed by and construed in accordance with the laws of England and Wales. Disputes arising here from shall be exclusively subject to the jurisdiction of the courts of England and Wales. Notwithstanding the foregoing, you agree that BBCW has the right in its discretion to commence any action in any non-UK jurisdiction in order to obtain injunctive or other relief, in the event that in BBCW’s opinion, it is desirable to do so.
